VYLINO — Website Ownership, Delivery and Handover Policy
Last updated: 15 October 2026. This policy forms part of an accepted VYLINO custom website project agreement to the extent incorporated in the signed quotation/order. Client rights under applicable law are preserved.
1. Website projects and handover
VYLINO builds, redesigns or configures websites in the scope and technology confirmed in each accepted project quotation or Statement of Work (SOW). The final deliverable may comprise a working WordPress/WooCommerce website, client-specific design, pages, approved content, standard administrative access and other expressly included components. Features, paid integrations, licences, code ownership, hosting support and data migration are limited to what was actually agreed.
2. Website ownership after final payment
Upon completion of the agreed project, full settlement of contracted fees and documented handover, the customer becomes the operator and controller of the completed website and receives the agreed rights and full usable access to administer, edit, host or transfer it. The customer owns its own logos, trademarks, text, original images, products, users and business information. Rights in bespoke development deliverables are transferred/licensed to the extent owned by VYLINO and expressly stated in the quote/handover. The customer may continue using third-party WordPress, theme, plugin, premium image, hosting, payment and software components only in accordance with their owners’ original licence terms. VYLINO cannot transfer third-party intellectual property or infrastructure it does not own.
3. Delivery checklist and evidence
VYLINO will provide a documented delivery notice, and to the extent included in the project scope:
- Website name/URL, completion and delivery dates, staging/production status, and agreed feature list;
- Website administrator or equivalent client access, account-owner transfer steps and password-reset recommendations;
- Identity of the hosting and domain account holder, renewal responsibility and any external provider services;
- Agreed content and database exports or website backup, if explicitly in scope, plus instructions on restoring or exporting where available;
- A list of theme/plugin licences and which ones require the customer to maintain, renew or purchase;
- Any outstanding approved corrections and support/maintenance period in writing;
- Final invoice and payment status, 50%–30%–20% milestones where applicable, and client delivery acknowledgement.
Customer confirmation of delivery records the agreed handover; it does not extinguish legal remedies for undisclosed or hidden defects.
4. Who is responsible after documented handover?
Client responsibilities: business operation and products; accuracy and lawfulness of content; end-user terms, refunds and representations; privacy/cookie notices, consent and processing decisions; tax/accounting and marketplace compliance; renewals of domain, hosting, SSL and third-party tools; administrator permissions and passwords; site backups, routine updates, malware monitoring, payment settings, customer-data retention and service provider choices. The client should use strong authentication, keep independent backups and limit third-party administrator access.
VYLINO responsibilities: deliver what was contracted using reasonable skill and care; securely manage access while acting for the client; provide the agreed handover and correction of proven defects within express warranty/statutory obligations; and honour continuing duties only where a separate hosting, maintenance, privacy/data-processing or support agreement expressly places those duties on VYLINO.
5. Post-delivery data loss, downtime and operational losses
After a completed documented handover, VYLINO is not responsible for outages, lost business, lost data, hacked accounts, expired renewals or website changes caused by the client, subsequent editors, third-party hosts, payment processors, outside developers or failures beyond VYLINO’s contractual control, except to the extent VYLINO’s own actionable negligent conduct, pre-existing delivery defect, unlawful activity or continuing agreed service caused or materially contributed to the issue. Building a site does not make VYLINO the continuing data controller, publisher, store operator or guarantor of its future uptime.
This limitation does not waive claims for deficient initial services, negligence, a material breach of the project agreement, fraud, misuse of credentials or any other non-excludable statutory liability. If the customer has purchased a VYLINO maintenance/hosting plan, responsibility is allocated by that active written service agreement for its duration.
6. Fees, milestones and delivery date
Unless separately agreed in writing, 50% of the one-time custom website project fee is payable before work begins, 30% when the agreed substantial build is ready for a working client preview, and 20% on the final delivery/go-live date. The start date is the later of confirmed initial payment and receipt of all initial required content, specifications and lawful account access. Customer-side delay pauses or reasonably extends the delivery estimate with written notice. The final 20% is invoiced on the delivery day, and administrative/control transfer is completed promptly when all contracted payment and agreed safe handover steps are fulfilled. The customer is informed of any legitimate payment or delivery dispute in writing.
Project payments compensate the described work. Money for work demonstrably carried out and authorised unavoidable third-party expenses may ordinarily be retained following client cancellation, but no advance is automatically forfeit solely because the work is digital. Visit our Refund and Cancellation Policy for remedies and the itemised review procedure.
7. Client acknowledgement and maintenance option
The client may acknowledge by email or signed/electronically accepted delivery record: “I confirm receipt of the agreed website deliverables, access and handover information and understand that day-to-day website operation, content, hosting renewals, user access, privacy compliance, backups, updates and future site changes are my responsibility after handover, except for written VYLINO support commitments and non-excludable rights.” This acknowledgement should be obtained from the authorised customer representative; a hidden or automatically pre-ticked box is not an appropriate substitute.
